V:01:05 Drug-Free Workplace

The purpose of this policy is to establish guidelines and standards for implementation of the Drug-Free Workplace Act of 1988 and the Drug-Free Schools and Communities Act Amendments of 1989 for Volunteer State Community College.

It is the policy of Volunteer State Community College in accordance to Tennessee Board of Regents that the unlawful manufacture, distribution, possession, use or abuse of alcohol and/or illicit drugs on Volunteer State Community College property as part of any activity of Volunteer State Community College is strictly prohibited. All categories of employees are subject to this policy and to applicable federal, state, and local laws related to this matter. Additionally, any violation of this policy will result in discipline up to and including termination.

The specifics of this policy are as follows:

  1. The unlawful manufacture, distribution, possession or use of a controlled substance is prohibited in the workplace. Such manufacture, distribution, possession or use while on the job will subject the violator to discipline up to and including termination.
  2. The term "controlled substance" means any drug listed in 21 USC Section 812 and other Federal regulations. Generally, these are the drugs which have a high potential for abuse. Such drugs include, but are not limited to, Heroin, Marijuana, Cocaine, PCP, and "Crack." They also include "legal drugs" which are not prescribed by a licensed physician to an alleged violator.
  3. A grant funded employee must notify The Director of Human Resources within five (5) days of receiving actual notice of a conviction. The Director of Human Resources will notify the Tennessee Board of Regents and the U.S. Government Agency within ten (10) days of receiving such notification.
  4. If an employee is convicted of violating any criminal drug statute while at the workplace, he or she will be subject to discipline up to and including termination. Alternatively, the Office of Human Resources may require the employee to successfully finish a drug abuse program sponsored by an approved private or governmental institution.
  5. As a condition of employment or continued employment on any federal government grant, the law requires all employees to abide by this policy. Volunteer State Community College is responsible for making a "good faith effort" to establish and maintain a drug-free workplace by following the steps enumerated in this policy. This effort requires the cooperation and support of each staff member in maintaining a "Drug-Free Environment."
