I:01:04 Tobacco Free Workplace
As of September 1, 2004, smoking and the use of smokeless tobacco (chewing tobacco, snuff) will be prohibited in any and all buildings, including buildings owned, leased, or rented by VSCC. Smoking is prohibited within twenty (20) feet of all doors to campus buildings and in areas clearly marked by tobacco-free/no-smoking signs, i.e., “This is a Smoke Free Environment No Smoking Beyond This Point.” Smoking and the use of other tobacco products is prohibited in all college-owned vehicles. This policy is in accordance with TCA 4-4-121.
Background
Health risks of tobacco usage, including exposure to environmental tobacco smoke, and smokeless tobacco are well known to all members of the VSCC community. The failure to address the practice of smoking or the use of smokeless tobacco in buildings at VSCC would constitute a violation of the Americans with Disabilities Act and the Vocational Rehabilitation Act. After verification of the legitimacy of complaints received from faculty, staff, and students with legitimate disabilities, consultation with appropriate medical professionals and upon recommendation of the appropriate college officials charged with implementation of these laws, it is our determination that this policy is a reasonable accommodation as defined by federal law.
Support
Understanding the addictive nature of some uses of tobacco products, VSCC will make every effort to assist those who may wish to stop smoking. When there is sufficient demand, VSCC will offer Smoking Cessation Programs.
Compliance
It is the responsibility of all members of the College community to observe this tobacco free workplace policy. Enforcement of this policy will be the primary responsibility of supervisors, the Chief of Police, and the Vice President for Business and Finance.
